font-size: small;\">Altera a Lei n\u00ba 11.952, de 25 de junho de 2009, que disp\u00f5e sobre a regulariza\u00e7\u00e3o fundi\u00e1ria das ocupa\u00e7\u00f5es incidentes em terras situadas em \u00e1reas da Uni\u00e3o, a Lei n\u00ba 8.666, de 21 de junho de 1993, que institui normas para licita\u00e7\u00f5es e contratos da administra\u00e7\u00e3o p\u00fablica, e a Lei n\u00ba 6.015, de 31 de dezembro de 1973, que disp\u00f5e sobre os registros p\u00fablicos.<\/span><\/p>\n<p class=\"Textbody\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><b>O PRESIDENTE DA REP\u00daBLICA<\/b>, no uso da atribui\u00e7\u00e3o que lhe confere o art. 62 da Constitui\u00e7\u00e3o, adota a seguinte Medida Provis\u00f3ria, com for\u00e7a de lei:\u00a0<\/span><\/p>\n<p class=\"Textbody\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Art. 1\u00ba A\u00a0ementa da Lei n\u00ba 11.952, de 25 de junho de 2009, passa a vigorar com as seguintes altera\u00e7\u00f5es:<\/span><\/p>\n<blockquote>\n<blockquote>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cDisp\u00f5e sobre regulariza\u00e7\u00e3o fundi\u00e1ria das ocupa\u00e7\u00f5es incidentes em terras situadas em \u00e1reas da Uni\u00e3o ou do Instituto Nacional de Coloniza\u00e7\u00e3o e Reforma Agr\u00e1ria &#8211; Incra, altera a Lei n\u00ba 8.666, de 21 de junho de 1993, e a Lei n\u00ba 6.015, de 31 de dezembro de 1973, e d\u00e1 outras provid\u00eancias.\u201d (NR)<\/span><\/p>\n<\/blockquote>\n<\/blockquote>\n<p class=\"Textbody\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Art. 2\u00ba \u00a0A Lei n\u00ba 11.952, de 2009, passa a vigorar com as seguintes altera\u00e7\u00f5es:<\/span><\/p>\n<blockquote>\n<blockquote>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 1\u00ba\u00a0\u00a0Esta Lei disp\u00f5e sobre a regulariza\u00e7\u00e3o fundi\u00e1ria das ocupa\u00e7\u00f5es incidentes em terras situadas em \u00e1reas de dom\u00ednio da Uni\u00e3o ou do Instituto Nacional de Coloniza\u00e7\u00e3o e Reforma Agr\u00e1ria &#8211; Incra, por meio da aliena\u00e7\u00e3o e da concess\u00e3o de direito real de uso de im\u00f3veis.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 2\u00ba \u00a0&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">VIII &#8211;\u00a0concess\u00e3o de direito real de uso: cess\u00e3o de direito real de uso, onerosa ou gratuita, por tempo certo ou indeterminado, para fins espec\u00edficos de regulariza\u00e7\u00e3o fundi\u00e1ria;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">IX &#8211; aliena\u00e7\u00e3o: doa\u00e7\u00e3o ou venda, direta ou mediante licita\u00e7\u00e3o, nos termos da Lei n\u00ba 8.666, de 21 de junho de 1993, do dom\u00ednio pleno das terras previstas no art. 1\u00ba;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">X &#8211; \u00e1rea urbana: a defini\u00e7\u00e3o levar\u00e1 em considera\u00e7\u00e3o, para fins do disposto nesta Lei, o crit\u00e9rio da destina\u00e7\u00e3o; e<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">XI &#8211; infra\u00e7\u00e3o ambiental: conduta lesiva ao meio ambiente comprovada por meio do esgotamento das vias administrativas.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 3\u00ba \u00a0&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">Par\u00e1grafo \u00fanico. Esta Lei aplica-se subsidiariamente a outras \u00e1reas sob dom\u00ednio da Uni\u00e3o, sem preju\u00edzo da utiliza\u00e7\u00e3o dos instrumentos previstos na legisla\u00e7\u00e3o patrimonial.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 4\u00ba \u00a0&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 2\u00ba\u00a0\u00a0As terras ocupadas por comunidades quilombolas ou tradicionais que fa\u00e7am uso coletivo da \u00e1rea ser\u00e3o regularizadas de acordo com normas espec\u00edficas.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 5\u00ba \u00a0&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">IV &#8211;\u00a0comprovar o exerc\u00edcio de ocupa\u00e7\u00e3o e de explora\u00e7\u00e3o direta, mansa e pac\u00edfica, por si ou por seus antecessores, anteriores a 5 de maio de 2014;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">V &#8211; n\u00e3o ter sido beneficiado por programa de reforma agr\u00e1ria ou de regulariza\u00e7\u00e3o fundi\u00e1ria de \u00e1rea rural, ressalvadas as situa\u00e7\u00f5es admitidas pelo Incra.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">Par\u00e1grafo \u00fanico. \u00a0Fica vedada a regulariza\u00e7\u00e3o das ocupa\u00e7\u00f5es em que o ocupante ou o seu c\u00f4njuge ou companheiro exer\u00e7am cargo ou emprego p\u00fablico nos seguintes \u00f3rg\u00e3os:<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">I &#8211; Minist\u00e9rio da Economia;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">II &#8211; Minist\u00e9rio da Agricultura, Pecu\u00e1ria e Abastecimento;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">III &#8211; Incra; ou<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 6\u00ba\u00a0\u00a0Preenchidos os requisitos previstos no art. 5\u00ba, o Incra, ou, se for o caso, o Minist\u00e9rio da Economia regularizar\u00e1 as \u00e1reas ocupadas por meio de aliena\u00e7\u00e3o.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 4\u00ba\u00a0\u00a0A concess\u00e3o de direito real de uso nas hip\u00f3teses previstas no \u00a7 1\u00ba do art. 4\u00ba ser\u00e1 outorgada pelo Minist\u00e9rio da Economia, ap\u00f3s a identifica\u00e7\u00e3o da \u00e1rea, nos termos do disposto em regulamento.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 13.\u00a0\u00a0Os requisitos para a regulariza\u00e7\u00e3o fundi\u00e1ria de im\u00f3veis de at\u00e9 quinze m\u00f3dulos fiscais ser\u00e3o averiguados por meio de declara\u00e7\u00e3o do ocupante, sujeita \u00e0 responsabiliza\u00e7\u00e3o penal, civil e administrativa.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 1\u00ba \u00a0O processo administrativo de regulariza\u00e7\u00e3o da \u00e1rea ser\u00e1 instru\u00eddo pelo interessado ou pelo Incra com:<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">I &#8211; a planta e o memorial descritivo, assinados por profissional habilitado e com a devida Anota\u00e7\u00e3o de Responsabilidade T\u00e9cnica &#8211; ART, contidas as coordenadas dos v\u00e9rtices definidores dos limites do im\u00f3vel rural, georreferenciadas ao Sistema Geod\u00e9sico Brasileiro;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">II &#8211; o Cadastro Ambiental Rural &#8211; CAR;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">III &#8211; as declara\u00e7\u00f5es do requerente e do seu c\u00f4njuge ou companheiro, sob as penas da lei, de que:<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">a) n\u00e3o sejam propriet\u00e1rios de outro im\u00f3vel rural em qualquer parte do territ\u00f3rio nacional e n\u00e3o tenham sido benefici\u00e1rios de programa de reforma agr\u00e1ria ou de regulariza\u00e7\u00e3o fundi\u00e1ria rural;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">b) exer\u00e7am ocupa\u00e7\u00e3o e explora\u00e7\u00e3o direta, mansa e pac\u00edfica, por si ou por seus antecessores, anteriormente a 5 de maio de 2014;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">c) pratiquem cultura efetiva;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">d) n\u00e3o exer\u00e7am cargo ou emprego p\u00fablico:<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">1. no Minist\u00e9rio da Economia;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">2. no Minist\u00e9rio da Agricultura, Pecu\u00e1ria e Abastecimento;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">3. no Incra; ou \u00a0<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">4. nos \u00f3rg\u00e3os estaduais e distrital de terras;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">e) n\u00e3o mantenham em sua propriedade trabalhadores em condi\u00e7\u00f5es an\u00e1logas \u00e0s de escravos; e<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">f) o im\u00f3vel n\u00e3o se encontre sob embargo ambiental ou seja objeto de infra\u00e7\u00e3o do \u00f3rg\u00e3o ambiental federal, estadual, distrital ou municipal; e<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">IV &#8211; a comprova\u00e7\u00e3o de pr\u00e1tica de cultura efetiva, ocupa\u00e7\u00e3o e explora\u00e7\u00e3o direta, mansa e pac\u00edfica, por si ou por seus antecessores, anteriores a 5 de maio de 2014, que poder\u00e1 ser feita por meio de sensoriamento remoto.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 2\u00ba \u00a0O Incra dispensar\u00e1 a realiza\u00e7\u00e3o da vistoria pr\u00e9via de im\u00f3veis de at\u00e9 quinze m\u00f3dulos fiscais, sem preju\u00edzo do poder fiscalizat\u00f3rio, ap\u00f3s an\u00e1lise t\u00e9cnica dos documentos referidos no \u00a7 1\u00ba, se verificado o preenchimento dos requisitos estabelecidos por esta Lei.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 3\u00ba \u00a0A realiza\u00e7\u00e3o de vistoria pr\u00e9via ser\u00e1 obrigat\u00f3ria nas seguintes hip\u00f3teses:<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">I &#8211; im\u00f3vel objeto de termo de embargo ou de infra\u00e7\u00e3o ambiental, lavrado pelo \u00f3rg\u00e3o ambiental federal;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">II &#8211; im\u00f3vel com ind\u00edcios de fracionamento fraudulento da unidade econ\u00f4mica de explora\u00e7\u00e3o;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">III &#8211; requerimento realizado por meio de procura\u00e7\u00e3o;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">IV &#8211; conflito declarado ou registrado na Ouvidoria Agr\u00e1ria Nacional;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">V &#8211; aus\u00eancia de ind\u00edcios de ocupa\u00e7\u00e3o ou de explora\u00e7\u00e3o, anterior a 5 de maio de 2014, verificada por meio de t\u00e9cnicas de sensoriamento remoto;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">VI &#8211; acima de quinze m\u00f3dulos fiscais; ou<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">VII &#8211; outras hip\u00f3teses estabelecidas em regulamento.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 4\u00ba \u00a0A vistoria realizada na hip\u00f3tese prevista no inciso I do \u00a7 3\u00ba verificar\u00e1 se o preenchimento de requisitos para a regulariza\u00e7\u00e3o fundi\u00e1ria decorreu de dano ambiental, situa\u00e7\u00e3o em que o pedido ser\u00e1 indeferido, exceto se o interessado tiver aderido ao Programa de Regulariza\u00e7\u00e3o Ambiental &#8211; PRA ou tiver celebrado termo de ajustamento de conduta ou instrumento similar com o \u00f3rg\u00e3o ambiental competente ou com o Minist\u00e9rio P\u00fablico.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 15\u00a0 &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">II &#8211;\u00a0o respeito \u00e0 legisla\u00e7\u00e3o ambiental, em especial quanto ao cumprimento do disposto no Cap\u00edtulo VI da Lei n\u00ba 12.651, de 25 de maio de 2012; No caso de descumprimento de contrato firmado com \u00f3rg\u00e3os fundi\u00e1rios federais at\u00e9 10 de dezembro de 2019, o benefici\u00e1rio origin\u00e1rio ou os seus herdeiros que ocupem e explorem o im\u00f3vel poder\u00e3o requerer a renegocia\u00e7\u00e3o do contrato firmado, nos termos a serem estabelecidos em regulamento.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: \u00e1rea apresentados atendem \u00e0s exig\u00eancias t\u00e9cnicas fixadas.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 3\u00ba \u00a0O Minist\u00e9rio do Desenvolvimento Regional participar\u00e1 da an\u00e1lise do pedido de doa\u00e7\u00e3o ou de concess\u00e3o de direito real de uso de im\u00f3veis urbanos e emitir\u00e1 parecer.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 24.\u00a0\u00a0Quando necess\u00e1ria a pr\u00e9via arrecada\u00e7\u00e3o ou a discrimina\u00e7\u00e3o da \u00e1rea, o Incra ou, se for o caso, o Minist\u00e9rio da Economia proceder\u00e1 \u00e0 sua demarca\u00e7\u00e3o, com a coopera\u00e7\u00e3o do Munic\u00edpio interessado e de outros \u00f3rg\u00e3os p\u00fablicos federais e estaduais, com posterior registro imobili\u00e1rio em nome da Uni\u00e3o.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 25.\u00a0\u00a0Na hip\u00f3tese prevista no \u00a7 2\u00ba do art. 21, o Minist\u00e9rio da Economia lavrar\u00e1 o auto de demarca\u00e7\u00e3o.<\/span><\/p>\n<p class=\"Textbody\"><span class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 5\u00ba\u00a0\u00a0A abertura de matr\u00edcula referente \u00e0 \u00e1rea independer\u00e1 do georreferenciamento do remanescente da gleba, nos termos do disposto no \u00a7 3\u00ba do art. 176 da Lei n\u00ba 6.015, de 1973, desde que a doa\u00e7\u00e3o ou a concess\u00e3o de direito real de uso sejam precedidas do reconhecimento dos limites da gleba pelo Incra ou, se for o caso, pelo Minist\u00e9rio da Economia, de modo a garantir que a \u00e1rea esteja nela localizada.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 28.\u00a0\u00a0A doa\u00e7\u00e3o e a concess\u00e3o de direito real de uso implicar\u00e3o o cancelamento autom\u00e1tico, total ou parcial, das autoriza\u00e7\u00f5es e das licen\u00e7as de ocupa\u00e7\u00e3o e de quaisquer outros t\u00edtulos n\u00e3o definitivos outorgados pelo Incra ou, se for o caso, pelo Minist\u00e9rio da Economia, que incidam na \u00e1rea.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 2\u00ba\u00a0\u00a0Para o cumprimento do disposto no\u00a0<b>caput<\/b>, o Incra ou, se for o caso, o Minist\u00e9rio da Economia far\u00e1 publicar extrato dos t\u00edtulos expedidos em nome do Munic\u00edpio, com indica\u00e7\u00e3o do n\u00famero do processo administrativo e dos locais para consulta ou obten\u00e7\u00e3o de c\u00f3pias das pe\u00e7as t\u00e9cnicas necess\u00e1rias \u00e0 identifica\u00e7\u00e3o da \u00e1rea doada ou concedida.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 33\u00a0 &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 1\u00ba\u00a0\u00a0Compete \u00e0 Secretaria Especial de Assuntos Fundi\u00e1rios do Minist\u00e9rio da Agricultura, Pecu\u00e1ria e Abastecimento o monitoramento de toda atividade fundi\u00e1ria federal.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 2\u00ba \u00a0O Incra, nos termos do disposto no par\u00e1grafo \u00fanico do art. 16 da Lei n\u00ba 4.504, de 30 de novembro de 1964, pode atuar em demandas que envolvam \u00e1reas ou im\u00f3veis rurais de dom\u00ednio da Uni\u00e3o, afetados ou pass\u00edveis de afeta\u00e7\u00e3o \u00e0 regulariza\u00e7\u00e3o fundi\u00e1ria de destina\u00e7\u00e3o \u00e0 reforma agr\u00e1ria ou a outro interesse social reconhecido.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u00a7 3\u00ba\u00a0 O disposto no \u00a7 2\u00ba\u00a0 se aplica \u00e0s a\u00e7\u00f5es ajuizadas anteriormente \u00e0 data de entrada em vigor desta Lei.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 34.\u00a0\u00a0O Minist\u00e9rio da Agricultura, Pecu\u00e1ria e Abastecimento e o Minist\u00e9rio da Economia criar\u00e3o sistema informatizado a ser disponibilizado na internet, com vistas a assegurar a transpar\u00eancia sobre o processo de regulariza\u00e7\u00e3o fundi\u00e1ria de que trata esta Lei.\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 38 \u00a0&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">I &#8211;\u00a0quando se tratar de ocupa\u00e7\u00f5es posteriores a 5 de maio de 2014 ou em \u00e1reas em que tenha havido interrup\u00e7\u00e3o da cadeia alienat\u00f3ria posterior \u00e0 referida data, desde que observado o disposto nos art. 4\u00ba e art. 5\u00ba e comprovado o per\u00edodo da ocupa\u00e7\u00e3o atual h\u00e1, no m\u00ednimo, um ano anterior \u00e0 data de entrada em vigor da Medida Provis\u00f3ria n\u00ba 910, de<\/span><br clear=\"all\" \/><span style=\"color: #000000;\">10 de dezembro de 2019;<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 40-A.\u00a0\u00a0Aplicam-se as disposi\u00e7\u00f5es desta Lei \u00e0 regulariza\u00e7\u00e3o fundi\u00e1ria das ocupa\u00e7\u00f5es nas \u00e1reas urbanas e rurais do Incra, inclusive nas \u00e1reas remanescentes de projetos criados pelo Incra, em data anterior a 10 de outubro de 1985 com caracter\u00edsticas de coloniza\u00e7\u00e3o, conforme estabelecido em regulamento.<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\u201d (NR)<\/span><\/p>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 40-B.\u00a0\u00a0N\u00e3o ser\u00e3o cobradas custas ou emolumentos para registro de t\u00edtulos translativos de dom\u00ednio concedidos pelo Incra de im\u00f3veis rurais de at\u00e9 quatro m\u00f3dulos fiscais.\u201d (NR)<\/span><\/p>\n<\/blockquote>\n<\/blockquote>\n<p class=\"Textbody\" style=\"text-align: justify;\"><span style=\"color: #000000;\">Art. 3\u00ba \u00a0A\u00a0Lei n\u00ba 8.666, de 21 de junho de 1993, passa a vigorar com as seguintes altera\u00e7\u00f5es:<\/span><\/p>\n<blockquote>\n<blockquote>\n<p class=\"Textbody\"><span style=\"color: #000000;\">\u201cArt. 17\u00a0
